      Hi everyone
      Please can I have some advice about what to do about the following situation.
      About 18 months ago I paid a Model Engineering supplier a lot of money to supply me with all the parts and castings for me to build a 2 in scale Traction Engine. After much toing and froing with phone calls and emails and lots of excuses, I eventually started getting bits and pieces sent to me. So far I have only received about half of what I ordered. Time is now dragging on and I’m not getting answers to my emails for weeks (if any) and when he does answer them it’s the same old excuses. I’m now sick and tired of him messing me about, and want to take action in getting the money that is owed to me, back. (Legal action) It’s quite difficult for me to visit him as I live in Jersey.

          Small Claims Court, assuming that it is possible considering your domicile. You would probably have to take action in the UK but I believe that may be possible on-line.

            Hi Gary, sorry to hear of ur troubles….

            seemingly u,Ve been quite fair with the firm/guy…..

            Now I hope all ur emails etc are available?.

            anyfurther phone conversations u must record, easy on an iphone etc…

            then I’d call him up and make sure he,s aware that u are unhappy and a letter (recorded delivery )is on it,s way asking for a complete refund or what ever u want….

            failure to reach a satisfactory agreement after 2week will leave u no option to go to small claims court…

            it,s very cheap…£50 I think ….

            then do what ever is nec….if they find him at fault he will just have to cough up ur money and court expenses…

            i believe but not sure, if they find in ur favour the money will be owed to the court…..

            even if u get judgement it,s not an automatic certainty that ur'll get ur money, u may have to take it even further…

            hope it it all works out for u….

              Look at the other threads on here about that supplier and you will see mention of how to take out a claim etc.

                Thanks for the replies. I'm kind of hoping he might see this and make contact with me. But I'm not holding my breath.

                  Don't be tempted to name and shame prematurely. It might prejustice your case.

                      From the other threads isn't it the case that he does eventually supply the parts just really slow and haphazard in the way he runs the business. Some of it is also due to the fact that castings are made in batches only occasionally.
                      It is a real pity he doesn't either sell some of the designs to someone with a suitable business record or get in a partner to help.

                      Edit: by the way it is better not to put your email on the open web for spammers to harvest. People can contact you using the PM system. The mods can remove the details if you ask nicely.

                        Suppliers should not take on orders unless they are in a position to fulfil them.

                        If there is likely to be a problem or a long delay, they should advise their customers accordingly .

                        This would not be too difficult and would avoid situations like this ,while ensuring that they retained their good name.

                        Sad to say, many don't even bother to answer calls or Emails [it,s quite common ]

                        I,m not sure how the Small Claims System works, but it sounds like the best in this case.

                          I'm looking for designs that are now out of copyright with a view to producing castings for same. I'd also be happy to discuss taking on some of those designs if the terms are right.

                              If you win small claims/county court and still no payment you can up it to the high court who send bailiffs round to demand entry to property and make inventory of possessions to remove for auction and debt recovery including clamping owners vehicles. All this as last resort if debtor really cannot /will not pay.

                              Good luck in resolving problem and next time pay by cr card so you can pass the buck to the card issuer.

                                Provided said items can be shown to belong to the company or individual you have the claim against.
