Why is sometimes I have a back cut with the fly cutter and sometimes not?

Your mill head may be slightly out of true to the table or out of tram as it is known.

Do you get it in one direction more than the opposite? if so the trailing edge is lower than the leading edge in the direction that is back cutting.

Can also be caused by a blunt tool being pushed off the work on the cut stroke and springing back down on the back cut.

Hi Nobby i was cutting 10x40mm mild steel using the power feed on the Centec mill, after i put up the post i played about a bit and found if i reduced the cut to 5thou it seamed a lot better in that there was no back cut can't remember the rpm but it was fairly slow around 390rpm i think, the feed rate is unknown because i have a vfd on the mill and was running a very slow feed rate, if I run from right to left that's when the problem seams worse than when going left to right, Jason may well be right in that may be the cut was to deep to start with (8-10thou) also the bed could be out also, the tool was very sharp and leaving a very good finish, spent a bit of time with it on the stone before starting had a nice radius and sharp edges, will have a more in depth look at it tomorrow.
