He's had sufficient warnings and requests to refund the deposit, you don't need an LBA, Go through the courts he can't win with the info you have provided, if he ignores the court he won't ignore the bailiffs (just ensue he's still trading first) the bailiffs cost around £70 but it all goes on his bill. and don't forget you want a reasonable amount for time spent dealing with this matter and all postage costs and don't forget to ask for interest you get 8%pa

          Hi Bob,

I have just sent my penultimate letter to Tim. I too have now cancelled and demanded the return of my initial deposit. If as I suspect there is no response I will certainly pursue the matter, no matter what it takes. In my opinion this is nothing less than fraudulent trading practice and needs to be stopped in its track

          Regards, Ted

A 'Statutory Demand' should get his attention.

A Statutory Demand cannot be used in this case as the amount in question is £220.

A Statutory Demand is only for an amount owed in excess of £750, since a Statutory Demand is the precursor to a winding up/bankruptcy order, and the minimum amount where you are deemed to be unable to pay your debts under Sections 222, 267 and 268 of the Insolvency Act 1986 is £750.
